Service description

TrainOwed is a compensation claim service that helps train passengers in the EU and UK submit delay compensation claims against train operators. We check your eligibility, prepare and submit the claim on your behalf, and follow up with the operator until a decision is reached. By using TrainOwed, you agree to these terms.

No-win, no-fee model

TrainOwed operates on a no-win, no-fee basis. If your claim is unsuccessful, you pay nothing. If your claim succeeds, we charge a success fee of 25% of the compensation amount. There are no upfront charges, no hidden fees, and no charges for unsuccessful claims.

The success fee is deducted before we transfer the remainder of the compensation to you. You will always receive a clear breakdown before any transfer is made.

Your obligations

To use TrainOwed, you must provide accurate and complete information about your journey. This includes the route, travel date, delay experienced, ticket type, and any booking references or ticket numbers associated with the journey.

Providing false or misleading information to support a claim is a serious matter and may constitute fraud. TrainOwed reserves the right to cancel any claim and terminate your account if we have reason to believe information provided is inaccurate or fabricated.

Claim assignment and authority

By submitting a claim through TrainOwed, you authorise us to act as your agent in relation to that claim. This means we can submit the claim to the relevant train operator, correspond with that operator on your behalf, receive any compensation awarded, and take reasonable steps to pursue the claim if it is initially rejected.

This authorisation is limited to the specific claim you have submitted and does not give TrainOwed any broader authority over your financial or legal affairs.

Fees and payment

Our success fee is 25% of the gross compensation amount awarded by the train operator. We deduct this fee from the compensation before transferring the remaining 75% to you via bank transfer or another payment method we support.

Payment is made to you promptly after we receive the compensation from the operator. We will notify you by email when a transfer has been made.

Limitation of liability

TrainOwed cannot guarantee that any claim will succeed. The final decision on whether to award compensation rests with the train operator, and in some cases with a relevant adjudication body. We act in good faith and use reasonable effort to pursue your claim, but we are not responsible for decisions made by third parties.

To the extent permitted by law, TrainOwed's liability to you in connection with any claim is limited to the amount of any success fee you have paid us in relation to that claim.

Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of TrainOwed will be subject to the exclusive jurisdiction of the courts of England and Wales.
