1. About TrainOwed
TrainOwed operates an online platform that helps train passengers in the EU and UK claim compensation for delays and cancellations. We check your eligibility, prepare and submit your claim to the relevant train operator on your behalf, and follow up until a decision is reached. By using TrainOwed, you agree to these terms.
2. Our Services
2.1 Free Eligibility Check
You can use our online tool to check whether your delayed or cancelled journey may qualify for compensation under EU Regulation 2021/782 or a UK Delay Repay scheme. This check is free, creates no obligation, and is an estimate based on the information you provide — not a legal opinion or guarantee.
2.2 Claim Handling
If your journey qualifies, TrainOwed submits and manages the claim on your behalf. We correspond with the train operator, chase outstanding responses, and pursue the claim through available escalation routes if it is initially rejected. We receive any compensation awarded, deduct our success fee, and transfer the remainder to you.
2.3 What TrainOwed Does Not Do
- Provide legal advice or legal representation
- Guarantee claim outcomes
- Initiate court proceedings on your behalf
3. No-Win, No-Fee Model
TrainOwed operates on a no-win, no-fee basis. If your claim is unsuccessful, you pay nothing. There are no upfront charges and no fees for unsuccessful claims.
If your claim succeeds, we charge a success fee of 25% of the gross compensation amount awarded by the operator. This fee is deducted before we transfer the remaining 75% to you. You will always receive a clear breakdown before any transfer is made.
4. Your Obligations
To use TrainOwed, you must provide accurate and complete information about your journey, including the route, travel date, delay experienced, operator, ticket type, and any booking references.
You must not submit claims you know to be fraudulent, misleading, or duplicate claims for the same journey already submitted through another service or directly to the operator. If your circumstances change materially after submission — for example, if you receive compensation through another channel — you must inform us promptly.
TrainOwed reserves the right to cancel any claim and terminate your use of the service if we have reason to believe the information provided is inaccurate or fabricated. Providing false information to support a claim may constitute fraud.
5. Claim Assignment and Authority
By submitting a claim through TrainOwed, you authorise us to act as your agent in relation to that claim. This authorisation covers submitting the claim to the relevant train operator, corresponding with that operator on your behalf, receiving any compensation awarded, and taking reasonable steps to pursue the claim if it is initially rejected.
This authorisation is limited to the specific claim you have submitted. It does not give TrainOwed any broader authority over your financial or legal affairs. You may withdraw this authorisation at any time by notifying us in writing, provided the claim has not yet been settled.
6. No Guarantee
The eligibility check provides an estimate only. TrainOwed cannot guarantee that any claim will succeed. The final decision rests with the train operator and, where applicable, with a relevant adjudication body. Operators may invoke extraordinary circumstances or other defences under applicable regulations. We act in good faith and use reasonable effort to pursue your claim.
7. Intellectual Property
All website content — including text, graphics, software, data compilations, and design — belongs to TrainOwed or is licensed to it and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
8. Limitation of Liability
To the extent permitted by law, TrainOwed's total liability to you in connection with any claim is limited to the amount of any success fee you have paid us in relation to that claim. We are not liable for:
- Decisions made by train operators or adjudication bodies
- Indirect, incidental, or consequential damages
- Loss of data, revenue, or anticipated savings
9. Right of Withdrawal
You may withdraw your claim authorisation at any time before settlement by contacting us at legal@trainowed.com. Where a claim has already been submitted to an operator and work has commenced, we reserve the right to charge a reasonable administration fee.
10. Dispute Resolution
We are committed to resolving disputes amicably. Contact us first at legal@trainowed.com. EU residents may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
11. Governing Law
These terms are governed by the laws of England and Wales, without prejudice to any mandatory consumer protection provisions in your country of residence. Disputes shall be submitted to the courts of England and Wales.
12. Changes to These Terms
We may update these terms periodically. The "last updated" date reflects the most recent revision. Material changes will be announced on this page. Continued use of TrainOwed after changes constitutes acceptance of the updated terms.
